Terms & Conditions - Advanced Hot Tubs and Swim Spas

The following terms and conditions apply to and are deemed to be incorporated in all contracts for the sale and supply of all products and materials from Advanced Hot Tubs and Swim Spas Ltd.

1. Prices

a. All prices shown include VAT at the statutory rate at the date of invoice.

b. Advanced Hot Tubs and Swim Spas Ltd reserves the right to alter prices (prior to agreed sale price) without notice.

2. Payment

a. All outstanding monies are payable in full on the date of delivery and/or installation.

b. In the case of payment other than by cash, payment shall not be deemed to have been made until the proceeds have been collected by Advanced Hot Tubs and Swim Spas Ltd.

3. Right to Title

Advanced Hot Tubs and Swim Spas Ltd retains the right to ownership of all goods supplied until payment is received in full into our bank account.

4. Delivery and Installation

a. All Advanced Hot Tubs and Swim Spas Ltd products are ordered direct from the manufacturer. At the time of ordering an approximate delivery date will be given. Advanced Hot Tubs and Swim Spas Ltd reserves the right to delay the delivery date if necessary.

b. Unless prior agreement is obtained installation of our Hot Tubs will take place at the time of delivery. Advanced Hot Tubs and Swim Spas Ltd reserves the right to apply costs of £75 per hour (including any part thereof) + VAT for any delays incurred as a result of the customer failing in his/her obligation to provide suitable means for the installation of the hot tub to take place at the agreed time/date.

c. Unless otherwise stated all goods are delivered flat packed (excluding Hot Tubs) for easy home assembly. Unless by prior agreement Advanced Hot Tubs and Swim Spas Ltd are not deemed liable for the erection of any goods provided.

d. The customer undertakes to accept delivery within the agreed date and to provide suitable facilities and labour for installation. The customer indemnifies Advanced Hot Tubs and Swim Spas Ltd against any additional costs resulting from any delay or damage to goods caused by non-provision of such facilities.

5. Returns for Credit

a. Goods are not accepted back for credit without prior consent from Advanced Hot Tubs and Swim Spas Ltd.

b. Advanced Hot Tubs and Swim Spas Ltd regrets that it cannot accept charges incurred by the customer for returning goods.

6. Loss of Goods in Transit/Transit Damage

a. Notification must be received within 24 hours of receipt of delivery.

b. In the event of obvious transit damage, it is imperative that both Advanced Hot Tubs and Swim Spas Ltd and the carriers are notified within 24 hours of receipt of delivery.

c. Advanced Hot Tubs and Swim Spas Ltd shall not be liable for any loss or damage caused by delay or nonperformance of any obligations under the contract where the delay or non-performance is due to causes beyond Advanced Hot Tubs and Swim Spas Ltd control.

7. Cancellation of Order

Advanced Hot Tubs and Swim Spas Ltd will accept cancellations of orders if within 14 days from the date of order.

8. Misuse of Products

Advanced Hot Tubs and Swim Spas Ltd will not accept responsibility for damage to any equipment in which our products are used for the purpose other than those for which they were designed.

9. Specifications

Advanced Hot Tubs and Swim Spas Ltd reserves the right to alter specifications without notice.

10. Health & Safety

All chemicals supplied by Advanced Hot Tubs and Swim Spas Ltd can constitute a health hazard if handled, stored or used incorrectly or imprudently. The customer should therefore acquaint him/herself with the appropriate health & safety information and take all necessary precautions to ensure that proper standards are maintained.

These Terms & Conditions do not affect the customer’s statutory rights.
